A FAIR SOLUTION CAN BE EASILY HAD FOR ALL!
Currently, the 14th Amendment to the US Constitution grants a “birthright” to any child born in the United States. I believe the below idea would be fair for all, this idea would solve the questions at hand:
1. Any individual that enters the US, without legal authority to do so, and has a child, the child should be the Citizenship of the Mother. No exceptions.
2. If someone enters the US, with legal authority, on a TEMPORARY BASIS, (temporary education/training, vacation, medical treatment, day trip across the border or anyone who remains after expiriation of their Visa) and a child is born, the child should be the citizenship of the Mother. No exceptions.
3. If someone enters the US, with legal authority and is a PERMANENT RESIDENT, actually living in the US, for a period of three (3) years with the intent on becoming a US Citizen themselves, and a child is born, the child should be a US Citizen. Welcome to the Party!
This recognizes law abiding persons that intend to apply for US Citizenship, and invest themselves in our Country. This does not reward temporary visitors with US Citizenship and it does not reward illegal aliens for violating our border and blowing off our laws.
